1. Acceptance of Terms
By accessing or using the services of Pure Benchmarks (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service. You must be at least 18 years old to use the Service.
Click-Wrap Consent: During sign-up, users must actively click a checkbox stating "I have read and agree to the Terms of Use." This ensures enforceability of Sections 10 (Arbitration) and related legal provisions.
Pure Benchmarks may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
2. Description of Service
Pure Benchmarks provides objective, algorithmically derived portfolio benchmarking, analytics, and comparative performance metrics based on user-authorized, read-only financial account data.
2.1 Source of Truth
The Service is a secondary display of information. The official and definitive record of your portfolio value, holdings, cost basis, and transaction history is held exclusively by your third-party brokerage or financial institution. Pure Benchmarks is not an official record-keeper.
User Responsibility: In the event of any discrepancy between the Service and your brokerage statement, you must rely solely on your brokerage's records. Users are responsible for regularly verifying all Service outputs against their official brokerage statements.
3. No Investment Advice / No Fiduciary Duty
The Service does not provide investment, financial, tax, legal, or other professional advice. Nothing on the Service constitutes a recommendation or guidance. No fiduciary relationship is created, and Pure Benchmarks assumes no duty of care to users beyond providing platform access. Users should consult licensed professionals for guidance.
4. Data & Third-Party Integrations / Lag Warning
You authorize Pure Benchmarks to collect read-only data from third-party financial institutions or aggregators (e.g., Plaid).
The Service may reflect stale or delayed data due to synchronization schedules or high-volatility periods.
Pure Benchmarks is not responsible for investment decisions made based on delayed, incomplete, or inaccurate data from third parties.
5. Objective Data Only
The Service provides algorithmically derived, objective portfolio analytics. Pure Benchmarks does not generate subjective interpretations or recommendations.
6. Portfolio Cloning & Peer Data
Users may view rankings and benchmarks of other portfolios. If a user elects to replicate, model, or copy another portfolio:
Such action is taken entirely at the user's own discretion and risk.
Pure Benchmarks shall not be responsible for any results or losses arising from such actions.
Rankings and benchmarks are relative metrics within our active user base and do not imply superior performance relative to the broader market.
7. Assumption of Risk
Use of the Service is at your own risk. Portfolio benchmarking involves risk, and historical data does not guarantee future results. No warranty is made regarding accuracy, completeness, or reliability of any data.
8. Limitation of Liability
To the maximum extent permitted by law, Pure Benchmarks and its affiliates shall not be liable for:
Any investment losses, lost profits, or opportunity costs
Indirect, incidental, special, punitive, or consequential damages
Reliance on benchmark data, rankings, or peer analytics
Third-party data failures or inaccuracies
Damage Cap:
For paying users: total liability shall not exceed the subscription fees paid in the preceding 12 months
For free users: total liability shall not exceed $100
9. Indemnification
You agree to defend, indemnify, and hold harmless Pure Benchmarks, its officers, directors, employees, and agents from claims arising out of:
Your use of the Service
Violation of these Terms
Misuse of the Service or third-party data
10. Arbitration & Class Action Waiver
All disputes shall be resolved by binding arbitration, and you waive any right to a jury trial or class action.
Small Claims Alternative: Either party may bring an individual action in small claims court as an alternative to arbitration.
11. Intellectual Property
All algorithms, methodologies, rankings, benchmarks, and software are proprietary. Users may not copy, modify, or distribute without written permission.
User Restrictions on Data Sharing
The Service and all content, including rankings, benchmarks, and analytics ("Service Content"), are provided solely for your personal, non-commercial use. You may not:
Reproduce, publish, or share Service Content on social media, forums, blogs, or other platforms without written consent from Pure Benchmarks.
Use the Service or Service Content for commercial purposes, including offering advisory services, consulting, or benchmarking to third parties.
Violations may result in termination of your account and potential legal action.
12. Subscription & Legacy Pricing
Founding user subscriptions—including Free, $5/month, and $10/month tiers—are limited to a fixed number of users and are offered at the sole discretion of Pure Benchmarks. Eligibility for these rates continues only while your account is active and in compliance with these Terms.
Legacy pricing is forfeited if:
Subscription is canceled
Payment fails for more than 30 days
Account is suspended for Terms of Use violations
Re-activation occurs at the then-current market rate.
13. Termination
Pure Benchmarks may suspend or terminate accounts at any time for violations of these Terms or misuse of the Service. Users may terminate by closing their accounts.

15. Data Security & Read-Only Architecture
Pure Benchmarks prioritizes the security of your financial information and operates under a Zero-Access policy.
Read-Only Access: The Service uses read-only integration tokens provided by third-party aggregators. Pure Benchmarks never requests, stores, or has access to your bank or brokerage login credentials, and will never email, call, or otherwise solicit your login information.
Security Reporting: If anyone claiming to be from Pure Benchmarks asks for your credentials, do not provide them. Immediately contact us at support@purebenchmarks.com to report the attempt.
No Transactional Authority: Pure Benchmarks cannot initiate transfers, execute trades, withdraw funds, or modify any external account data.
Encryption: All transmitted data is encrypted using industry-standard protocols (e.g., TLS/SSL) and stored in a secure, siloed environment.
User Responsibility: You are responsible for safeguarding your Pure Benchmarks account credentials and must notify us immediately of any unauthorized access.
16. Account and Portfolio Deletion
Users may delete their Pure Benchmarks account or remove individual portfolios at any time.
Permanent Data Loss: Deleting an account or portfolio will permanently erase all associated data, including historical performance, benchmarks, and analytics. This action cannot be undone.
User Responsibility: You acknowledge and accept that it is your sole responsibility to retain any historical records or backup data prior to deletion. Pure Benchmarks is not liable for any consequences arising from deleted accounts or portfolios.
